Privacy Policy

How Mirza Media, operated by Emmanuel Mirzakhanian (ABN 63 901 298 793) collects, uses, stores and discloses personal information.

1. About this policy

This policy applies to mirzamedia.org and to all services provided by Mirza Media, operated by Emmanuel Mirzakhanian (ABN 63 901 298 793) (“we”, “us”, “our”). It explains what personal information we collect, why we collect it, who we disclose it to, and how you can access, correct or complain about it.

We are a small business and are therefore not required to comply with the Privacy Act 1988 (Cth). We handle personal information in accordance with the Australian Privacy Principles regardless, and this policy is written on that basis.

“Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable.

2. What personal information we collect

We collect only what we need in order to respond to you and to provide our services. Depending on how you deal with us, this may include:

  • your name and the name of your business;
  • your email address, and a telephone number if you give us one;
  • your business address and ABN;
  • the content of any correspondence between us;
  • booking details, where you schedule a call with us;
  • billing information, where you become a client; and
  • technical information automatically recorded by our hosting provider, such as your IP address, browser type and the time of your request.

We do not collect sensitive information as that term is defined in the Privacy Act 1988 (Cth), and we do not knowingly collect personal information from children.

3. How we collect it

We collect personal information directly from you where possible, such as when you email us, book a call, or engage us to provide services.

We also collect information about businesses from publicly available sources before making contact. This includes public government registers, business websites, and public advertising records such as the Google Ads Transparency Center. Where that information identifies an individual (for example, a director named on a public register), it is personal information and this policy applies to it.

4. Why we collect it and how we use it

We use personal information to:

  • respond to your enquiry and correspond with you;
  • prepare and send you a review of your existing advertising;
  • provide, manage and report on services you have engaged us for;
  • issue invoices and keep the records we are required by law to keep; and
  • send commercial messages of the kind described in clause 08.

We do not sell personal information, and we do not disclose it for anyone else's marketing purposes.

5. Website tracking and analytics

This website. mirzamedia.org uses Cloudflare Web Analytics to count visits. It sets no cookies, does not store or send any information that identifies you, and does not follow you to any other website. It records the page you opened, the site you arrived from, your general location by country, and how quickly the page loaded. There is no advertising tracker and no cross-site tracking of any kind. Our hosting provider also records standard server logs, as described in clause 02.

Pages prepared for a specific business. Where we send you a link to a page prepared about your own business, that page records six events and associates them with the link we sent you:

  1. that the page was opened, and the site you arrived from;
  2. that the video on it was played;
  3. that the video was still open after thirty seconds;
  4. that you scrolled as far as our findings;
  5. when you left the page, how long you had it open and how far down the page you reached; and
  6. that the booking link was selected.

It records nothing else. It does not record what you type, what you do after leaving the page, or any information about your device beyond what is described in clause 02. We use it only to judge whether the material we prepared was of any use. If you would prefer we did not hold it, tell us and we will delete it.

6. Cookies

This website does not set cookies.

Our booking provider sets cookies necessary for its own operation when you open a booking page. You can control cookies through your browser settings; disabling them may prevent that booking page from working.

7. Who we disclose personal information to

We disclose personal information only where it is necessary, and only to:

Our booking provider (Cal.com)
Receives your name, email address and chosen time when you book a call.
Our email provider
Stores our correspondence with you in the ordinary course of delivering and holding email.
Our website host (Cloudflare)
Processes requests to this website, records standard server logs, and provides the visit counting described in clause 05.
Advertising platforms
Where you are a client and have asked us to manage advertising accounts on your behalf, within those accounts and on your instructions.
Our professional advisers and regulators
Where required in connection with our accounting, insurance or legal obligations, or where disclosure is required or authorised by law.

We do not disclose personal information to any other party without your consent.

8. Direct marketing and how to opt out

We may send you a commercial electronic message about our services where we have your consent, including consent inferred from your business's published contact details and the relevance of the message to that business, as permitted under the Spam Act 2003 (Cth).

Every such message identifies us and contains a functional way to opt out. Replying with the word “stop”, or any clear indication that you do not wish to be contacted, is sufficient. We action opt-outs on receipt and in any event within five working days, and we do not charge for it.

Opting out of marketing does not affect correspondence about services you have engaged us to provide.

9. Overseas disclosure

Some of the providers listed in clause 07 store data outside Australia, including in the United States and the European Union. By providing personal information to us you consent to that disclosure.

We take reasonable steps to deal only with providers that are subject to binding privacy or data protection obligations, but we cannot control the laws of every jurisdiction in which they operate.

10. Storage and security

Personal information is held in cloud services protected by access control and multi-factor authentication, and on encrypted local storage. We take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a data breach likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner in line with the Notifiable Data Breaches scheme.

11. How long we keep it

We keep personal information only for as long as we need it for the purposes described in this policy, or for as long as we are required to keep it by law. Financial records, for example, must be retained for seven years under the Income Tax Assessment Act.

Where you have asked not to be contacted, we keep the minimum record necessary to make sure we do not contact you again. Deleting that record entirely would defeat its purpose.

12. Accessing and correcting your information

You may ask us at any time what personal information we hold about you, and we will tell you. You may ask us to correct anything that is inaccurate, out of date, incomplete or misleading, and we will correct it.

You may also ask us to delete what we hold, and we will do so unless we are required by law to keep it. There is no charge for any of this, and we will respond within thirty days.

13. Complaints

If you believe we have mishandled your personal information, please tell us first at emmanuel@mirzamedia.org. We will acknowledge your complaint within five working days and respond substantively within thirty days.

If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

14. Changes to this policy

We may update this policy from time to time. The current version is always published at mirzamedia.org/privacy/ and is dated at the top of the page. Material changes will be reflected in that date.
